    Perfil da judicialização de dispositivos fisioterapêuticos e seu custo direto no município do Rio de Janeiro

    The legalization of health phenomenon consists of one option for citizens, to ensure their right to health, as provided by the Constitution of 1988. Considering the progressive impact of this phenomenon to the public coffers and lack of information about physiotherapeutic devices judicialization, in this dissertation it sought primarily to draw the profile of legalization of physical therapy devices in the municipality of Rio de Janeiro, through the analysis of lawsuits submitted to the Technical Advisory Core of the Court of Justice of Rio de Janeiro State, from May 2013 to September 2015. Secondly, estimating the direct cost of the purchase of devices pleaded in such actions. It is noteworthy that all processes were requested individually, using the legal tool for early relief, justified, almost entirely, by the urgent need of the devices. In 79.8% of cases there was demand for assistance of the Public Defender. In 62.9% of cases the authors presented age above 60 years. The predominant causes of requests were due to chronic respiratory diseases, the most demanded the apnea-hypopnea Obstructive Sleep Syndrome (30.9%), Chronic Obstructive Pulmonary Disease (14.4%) and pulmonary fibrosis (10.7 %), thus justifying the vast majority of demands for devices for treating such conditions. Among the most judicialized devices are CPAP - Continuous Positive Airway Pressure (20.6%), oxygen concentrator (17.3%) and the oxygen cylinder (13.5%). None of the devices is included in the official lists of government to dispensation. It was estimated with the purchase of required devices for the purpose of compliance with the court orders, an expense of approximately R$ 2.6 million reais in the period analyzed, which features a high impact on the municipal budget of Rio de Janeiro.
